Do we have any lawyers in the house? Can Traianos Dellas take legal action against this picture that we created with Phosothsop? It would be Dellas v greeksoccer.com... it could either breaks us or make us as a trial...

Yiannis - there may be some issues here ... if you want to just cover yourself just in case you can always add in small text below the picture something like this:

This photo was made for the www.soccer.gr forum, and is not connected to the EPO, T. Dellas, etc etc etc.

What others have said is basically correct ... you'd need Dellas to see it, get offended by it, and contact you about it. I doubt it would happen - but ya never know since people/companies are very odd about this stuff. Example - my friend set up a website to sell some frames (for glasses) as a side business. He tried using frames-r-us.com but was immediatly contacted by Toys 'R Us telling them that they own all types of the "R Us" name ... so they had to change the web address.

kinda funny and kinda stupid - but that's the way it is I guess.

Yianni,

As Knight said, you should be OK as long as you place a disclaimer below the photo. If you're serious and need help with the language, contact me via pm.

From a practical standpoint, as long as you're not attempting to derive an economic benefit from it, there should be no problem. And if you were, the normal procedure would be to first receive a cease and desist letter from the "aggrieved" party. That is, stop doing what you're doing for the following reasons..........

Well Yianni is selling these scarves so it can be said he will have some economic gain from them, but who givesa damn anyway.
We dont need lawyers to tell us that t Yiannis might have some legal repurcussions, we are Greek and we will do what we have to do , keep the pic up Yianni and dont worry about it.
Dellas is an Ellinara.
The only way he would find out anyway is if the BIG ROUFIANO in here perhaps sends this link to EPO and dont for one minute put it past him from doing it....fear him Yianni , dont fear what you a have done...eimaste mazi sou...kai mhn akous ti sou lene oi dikigoroi, there are always 2 sides of the law.....

Guys there are two risks at hand when you do something like this (ie., use someone's photo for commercial purposes as opposed to reporting on newsworthy events). 1) the person(s) in the image, and 2) the photographer that took the photo as he has a copyright in the pic he took as both parties have a right to control how they are used for commercial purposes.

On the issue of the disclaimer, it may provide an arguement that the pic does not constitute an endorsement of the product (website, scarf) by EPO or Dellas but will not necassarily be of great use when asked whether consent was secured for using someone image for commercial purposes.

If there is a concern about using the image, then it is recommended that a release or a license be secured for further use. Usually, the photographer/agency has already secured necessary rights from the people in the photos and will indemnify if anyone brings a lawsuit. Any license should also include the right to modify the photo (as was done with this one) and will probably be accompanied with some restrictions.
